1. Agreement
These Terms and Conditions ("Terms") govern your membership in the Lavon Loyalty Plan ("Membership") offered by Lavon Restoration and Remodeling LLC ("Lavon," "we," "us," or "our"). By enrolling, you ("Member," "you") agree to these Terms. These Terms supersede document version LLP-TC-v1.1 in its entirety.
Please read Section 5 carefully. It describes how repair work is classified and priced, including the difference between a Standard Repair and a Major Repair. Please read Section 6 carefully. It describes your right to cancel.
2. What the Membership Is
The Lavon Loyalty Plan is a recurring home maintenance membership priced at $27.00 per month. Active Members receive:
- One exterior home inspection per membership year. Your first inspection is scheduled within 30 days of your first successful payment. Subsequent inspections occur approximately on the same date each year.
- Limited minor preventive maintenance performed during the annual inspection, when safely accessible and appropriate, within the scope described in Section 4.
- A documented Home Health Report with photographs and recommendations, delivered within one business day after a completed inspection.
- Access to Lavon for interior or exterior repair requests.
- Transparent repair pricing on qualifying member repair work, with no additional Lavon markup on Standard Repairs, as described in Section 5.
- A declining Lavon Loyalty Fee on remodeling projects, based on continuous active membership, as described in Section 7.
3. What the Membership Is Not
The Membership is not insurance, not a home warranty, not a home service contract, not a repair-coverage plan, not an annual repair fund, and not a 24/7 emergency service.
The Membership does not include and does not provide:
- Free repairs or free remodeling. Repairs and remodeling projects are always separately paid work. The Membership changes how that work is priced and documented, not whether it is paid for.
- Covered repairs, repair credits, repair allowances, repair limits, or repair funds
- Payment by Lavon for any homeowner damage, leak, loss, or repair
- Interior inspections as part of the annual membership inspection
- Emergency or after-hours response
- Any guarantee of response time, diagnosis, repair completion, or availability
- Insurance claim representation, adjustment, negotiation, appraisal, or any guarantee of insurance payment
- Responsibility for damage caused by neglect, active or future leaks, concealed defects, weather, pests, system failure, deterioration, prior work, or conditions arising between inspections
- Any guarantee that the annual visual exterior inspection will identify every issue or prevent future damage
- Remodeling work at no charge
4. Annual Exterior Inspection
4.1 Scope
The annual inspection is exterior-only, visual, limited, and non-invasive. It is not a whole-home inspection, roof certification, insurance inspection, engineering evaluation, mold inspection, plumbing inspection, electrical inspection, HVAC inspection, or interior inspection.
We inspect visible and safely accessible conditions involving: the roof from appropriate accessible vantage points; gutters and downspouts; fascia and soffit; drip edge; exterior window seals and visible caulking; siding and exterior trim; visible staining, deterioration, penetrations, openings, and sealant conditions; visible pest or rodent entry points; and other visible exterior risks within the inspector's training and scope.
4.2 Limitation
This annual exterior membership inspection is visual, limited, and non-invasive. It does not guarantee the absence of leaks, concealed defects, interior issues, system failure, deterioration, pest activity, weather damage, or future damage. The inspection and limited preventive maintenance do not make Lavon responsible for conditions that develop, worsen, or remain hidden between inspections.
4.3 Minor Preventive Maintenance
Performed only when safe, accessible, and practical, and limited to: resealing exposed roof nails where appropriate; resealing minor visible window-caulk gaps; sealing minor visible openings in fascia or soffit; minor exterior sealant touch-ups; and other low-risk preventive actions specifically approved by Lavon management.
Not included: major roof repair or shingle replacement, window replacement, major siding, fascia, or soffit replacement, structural correction, gutter replacement, pest treatment, mold remediation, water mitigation, interior work, or plumbing, electrical, HVAC, water heater, foundation, or specialty-system work.
4.4 Access
You agree to provide safe and reasonable access to the exterior of the property, and to disclose gate codes, pets, HOA requirements, and any known hazards. We may reschedule or limit an inspection where conditions are unsafe, including weather, animals, obstructions, or unsafe roof access.
5. Repair Work, Classification, and Transparent Pricing
5.1 Repairs Are Separate
Repairs are separate paid projects requiring separate written authorization. They are not included in and are not paid for by the $27 monthly Membership fee. Repair work is priced according to its classification under Section 5.3.
5.2 Documented Direct Cost
"Documented Direct Cost" means actual, verifiable costs directly attributable to a specific project: actual subcontractor labor invoiced to and paid by Lavon; actual employee payroll, payroll taxes, and directly attributable labor burden where work is self-performed; actual supplier material invoices; and actual permit, inspection, equipment rental, delivery, dump, disposal, or other job-specific third-party costs.
General office overhead, routine vehicle cost, marketing, general sales commissions, ordinary management salaries, and profit will not be embedded within "labor" or "materials." Any separate charge must be clearly named and disclosed to you before you authorize the work.
5.3 Repair Classification
Every repair is classified in writing as either a Standard Repair or a Major Repair before the final estimate is issued. The classification determines the pricing method.
Standard Repair. Work primarily intended to restore an existing area, component, finish, or protective exterior feature to substantially its prior function, condition, appearance, or weather resistance, where the estimated Documented Direct Cost does not exceed $3,000 and the work does not meet any Major Repair criterion below. Examples may include localized drywall repair, limited flooring repair, minor exterior trim or siding repair, small fascia or soffit repair, localized sealant repair, and similar limited restoration work.
Major Repair. Repair work primarily intended to restore existing property, rather than improve or reconfigure it, that meets one or more of the following:
- The estimated Documented Direct Cost exceeds $3,000
- The work requires a permit
- The work requires coordination of two or more trades
- The work requires significant demolition, reconstruction, drying, restoration, roof repair beyond a minor localized repair, or substantial material replacement
- The work requires substantial scheduling, project management, homeowner coordination, safety management, or warranty administration
- A single repair scope is divided into multiple estimates, invoices, phases, or work orders that are reasonably related to the same condition, event, affected area, or repair objective and would exceed $3,000 in total if combined
A Major Repair remains a repair. It does not become a Remodeling Project merely because it is expensive or extensive.
5.4 Standard Repair Pricing
For an active Member in good standing, Standard Repairs are priced as: Documented Direct Labor + Documented Direct Materials + Documented Direct Job Costs + $0 additional Lavon repair markup. Neither the Lavon Major Repair Fee nor the Lavon Loyalty Fee applies to a Standard Repair.
5.5 Major Repair Pricing
For an active Member in good standing, Major Repairs are priced as: Documented Direct Labor + Documented Direct Materials + Documented Direct Job Costs + Lavon Major Repair Fee.
The Lavon Major Repair Fee equals 10% of the total Documented Direct Cost of the approved Major Repair. It is a fixed percentage and does not vary with membership tenure. The fee compensates Lavon for project management, coordination, scheduling, quality control, documentation, homeowner communication, and warranty administration on larger repair work. It appears as its own clearly labeled line item and is never embedded within labor, materials, permits, rental, disposal, or subcontractor charges.
The Lavon Major Repair Fee applies only to Major Repairs. It does not apply to Standard Repairs and does not apply to Remodeling Projects.
| Cost category | Amount |
|---|---|
| Documented labor cost | $4,500 |
| Documented material cost | $2,500 |
| Documented job-specific third-party costs | $1,000 |
| Total Documented Direct Cost | $8,000 |
| Lavon Major Repair Fee — 10% | $800 |
| Total Member Price | $8,800 |
5.6 Estimates and Disclosure
Every repair estimate and final invoice includes a Member Cost Breakdown showing: the project classification, scope, labor source, direct labor cost, direct material cost, other direct job costs, the applicable fee stated separately (shown as $0 on a Standard Repair), total price, supporting documentation where available, estimate expiration date, and change-order terms. Concealed conditions and scope additions discovered during work require your written approval before proceeding.
5.7 Reclassification and Change Orders
If concealed conditions, code requirements, scope changes, additional damage, trade requirements, permit requirements, or material availability materially change a project after work begins, Lavon may propose reclassification through a written change order. No fee, fee increase, or reclassification may be charged without your written approval, except for emergency protective work you separately authorize.
5.8 No Job Splitting
Lavon will not intentionally split a single Major Repair into multiple invoices, work orders, projects, phases, or estimates to avoid disclosure of the Lavon Major Repair Fee. Likewise, a Member may not direct related work to be artificially divided to avoid Major Repair classification. Related repair work arising from the same condition, event, affected area, or repair objective may be combined when determining whether the $3,000 threshold applies.
5.9 No Comparative Guarantee
Transparent pricing means you see Lavon's documented direct costs. It is not a guarantee that Lavon's total price will be lower than any other contractor's price for the same work.
6. Cancellation
6.1 Three-Day Right to Cancel
If you purchased this Membership at your home, or at any location other than Lavon's regular place of business, you have the right to cancel this transaction without penalty or obligation within THREE BUSINESS DAYS of the date of purchase.
To cancel within this period, notify Lavon in writing at Info@lavonrandr.com, or cancel through your member billing portal, before midnight of the third business day following your purchase. If you cancel within this period, you will receive a full refund of any amount paid and no inspection will be scheduled or performed. A Notice of Cancellation form is included as Appendix A to this document.
If you purchased this Membership online through our website, this three-day right does not apply. You may still cancel at any time under Section 6.2.
6.2 Cancel Anytime
You may cancel your Membership at any time through your member billing portal. There is no cancellation fee, no minimum commitment, no inspection clawback, no cancellation penalty, and no requirement to call us to cancel. Cancellation requests generate an immediate confirmation and a timestamped account record.
- Your Membership remains active through the end of the billing period you have already paid for.
- No new monthly charge will be initiated after your effective cancellation date.
- You do not receive a prorated refund for the already-paid monthly period unless we separately choose to provide one.
- If your annual inspection has already been completed, you may still cancel at any time without any additional charge.
- If you cancel before your first inspection, Lavon has no obligation to perform that inspection after your membership end date.
- If an inspection is already scheduled after your cancellation but before your membership end date, we will ask whether you wish to keep or cancel that appointment. No pressure or penalty applies either way.
6.3 Effect on Other Agreements
If you have separately signed a repair or remodeling contract, that contract remains enforceable according to its own terms. Cancelling your Membership does not void a signed repair or remodeling agreement. The pricing method, classification, and fee applicable to a repair or remodeling project are determined and locked when the applicable project agreement is signed, unless that agreement expressly states otherwise.
6.4 Tenure
Cancellation stops future loyalty-tenure accrual. If you rejoin later, loyalty tenure resets unless a written owner-approved exception is recorded.
7. Remodeling and the Lavon Loyalty Fee
Remodeling is always a separate paid project under a separate remodeling agreement. It is not repair work and is not part of the $27 Membership fee. Remodeling work is not provided free of charge.
A "Remodeling Project" is elective work intended primarily to improve, upgrade, redesign, reconfigure, modernize, change layout, alter finishes, increase functionality, or change the appearance or use of an area beyond restoring it to substantially its prior condition. Examples include kitchen remodeling, bathroom remodeling, elective flooring replacement, cabinet replacement, layout changes, custom finish work, and aesthetic renovation.
7.1 What You Pay on a Remodeling Project
For remodeling projects, Members pay documented direct labor cost, documented material cost, documented permit, inspection, and other job-specific third-party costs, plus the Lavon Loyalty Fee described below. No additional charge is applied beyond these items.
7.2 The Lavon Loyalty Fee
The remodeling management and quality-control fee is named the Lavon Loyalty Fee. It appears under that name as its own clearly labeled line item on every remodeling estimate and invoice, and is never embedded within labor or materials. Active Members receive a declining Lavon Loyalty Fee based on continuous active membership as of the date the remodeling agreement is signed:
| Continuous active membership at signing | Lavon Loyalty Fee |
|---|---|
| Enrollment through month 5 | $3,000 |
| After 6 consecutive active months | $2,500 |
| After 12 consecutive active months | $2,000 |
| After 18 consecutive active months | $1,500 |
| After 24 consecutive active months | $1,000 (minimum fee) |
- The fee is calculated and locked when the separate remodeling agreement is signed.
- You must be active and paid current on the date of signing.
- The fee applies to each remodeling contract separately.
- The fee decreases by $500 for every six consecutive months of active membership, to a minimum of $1,000 after twenty-four months. It does not decrease further.
- Cancelling your Membership after a remodeling agreement is signed does not change the fee already locked in that agreement, unless that agreement expressly says otherwise.
- Cancelling before a remodeling agreement is signed ends eligibility for member pricing and this fee schedule.
- Membership tenure pauses during nonpayment and resets after cancellation unless a written owner-approved exception is recorded.
7.3 No Double Fee
A single project is classified as either a Standard Repair, a Major Repair, or a Remodeling Project for pricing purposes. A single project will not be charged both the Lavon Major Repair Fee and the Lavon Loyalty Fee unless you expressly approve separate, independently scoped repair and remodeling agreements. The applicable classification, fee category, calculation method, and fee amount will be disclosed to you in writing before you authorize work.
8. Billing
8.1 Recurring Authorization
By enrolling, you authorize Lavon to charge $27.00 per month to your payment method on a recurring basis until you cancel. Your billing date is set by your enrollment date.
8.2 Failed Payments
If a payment fails, we will attempt to notify you by email and text and will retry the charge. If payment is not resolved, your Membership may be placed in Past Due status, during which nonessential member services may be suspended and loyalty tenure accrual pauses. Continued nonpayment may result in cancellation.
8.3 Price Changes
We may change the Membership price with at least 30 days' advance written notice to the email address on your account. If you do not wish to continue at the new price, you may cancel before it takes effect.
8.4 Taxes
Prices do not include any applicable state or local taxes, which will be added where required by law.
9. Communications Consent
By enrolling, you consent to receive communications from Lavon Restoration and Remodeling LLC at the email address and phone number you provide, including transactional messages — appointment confirmations, reminders, inspection reports, invoices, billing notices, and account updates — and promotional and marketing messages — newsletters, seasonal maintenance education, service offers, and program updates.
Message and data rates may apply. Message frequency varies. Consent to marketing messages is not a condition of purchase. Reply STOP to any text message to unsubscribe from texts, or use the unsubscribe link in any marketing email. You will continue to receive transactional messages related to your Membership. We do not sell your personal information. See our Privacy Policy for details.
10. Disclaimers and Limitation of Liability
10.1 No Warranty of Detection
Lavon does not warrant that the annual exterior inspection will detect all defects or prevent future damage. The inspection is a limited visual review at a single point in time.
10.2 Workmanship Warranty
Repair and remodeling work performed by Lavon under a separate signed agreement carries the workmanship warranty stated in that agreement. The Membership itself carries no warranty on any home component.
10.3 Limitation
To the maximum extent permitted by law, Lavon's total liability arising out of or relating to the Membership shall not exceed the total Membership fees you paid to Lavon in the twelve months preceding the claim. Lavon shall not be liable for indirect, incidental, consequential, special, or punitive damages. Nothing in this section limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law. This limitation does not apply to Lavon's obligations under a separate signed repair or remodeling agreement.
11. Changes to These Terms
We may update these Terms. Material changes will be communicated to the email address on your account at least 30 days before taking effect. Continued Membership after the effective date constitutes acceptance. The version number and date appear at the top of this document.
12. General
Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Entire agreement. These Terms constitute the entire agreement regarding the Membership and supersede prior representations regarding the Membership, including document version LLP-TC-v1.1. Separate repair and remodeling agreements govern their own subject matter.
Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
Assignment. You may not assign your Membership without our written consent. Membership is tied to the property address on your account.
Contact. Questions about these Terms: Info@lavonrandr.com or (737) 734-4279.
